Wow downloading music is gonna come back and bite you in the ass.

Joel Tenenbaum, a 25 year old graduate student studying for a PhD in Physics, admitted using a variety of peer-to-peer software including Kazaa, iMesh and Napster to download and distribute the 30 songs focused on in the case, and admitted that he had lied during his first deposition in September 2008 when he suggested that some songs had been downloaded to his computer by family members or friends.

Evidence gathered using MediaSentry revealed that Tenenbuam was sharing 800 songs from his computer in August 2004, according to Ars Technica. He started sharing files in 1999, was warned by his father that he would get sued in 2002, received a warning letter from the law firm of the plaintiffs in this case in 2005, was sued in 2007, and only stopped part the way through 2008.

In a fairly one-sided trial, Judge Nancy Gertner found Tenenbuam guilty of violating copyright laws and left the jury to decide how much damages should be awarded - with US law stating that the record companies are entitled to between $750 and $30,000 for each of the 30 songs, or up to $150,000 per track if the infringments are found to be wilful. The jury decided on $22,500 for each infringement. The recording labels involved in the case were subsidiaries of Universal Music, Warner Music and Sony.

Yikes. Definitely makes paying back his education a little tougher...

As far as I know, legislation with regards to downloading in Canada isn't as strict as it is in the States.

Makes me wonder why he, of all the people downloading in the U.S., was the one sued.

i heard that the accused get letters in the mail advising them to stop, then if they continue they are charged/fined around $1500. after that, if they refuse to pay and continue to illegally download (as he did) they are sued by the record companies. its a long, drawn out ordeal. otherwise, they could sue just about everyone if they wanted.

I read an article about the music business just today that I thought was good. Basically discussing how they had a business model in the past that they really made money selling the item and lured in bands with their distribution power.

Well the internet takes away their distribution power and the items are available at a much lower cost per unit because you aren't giving them anything physical (people will pay less).

End of the day, they are using an outdated business model and are trying to keep it intact by suing the pants off everyone.

It won't work in the long run.

The music industry has changed over the last 30 years.

Instead of taking twenty million dollars and investing one million dollars into developing and promoting twenty different artists, they'd rather take twenty million dollars and invest it into promoting one of thier tried and true cash cow artists.

Think of all the awesome artists from the 60's and 70's that we would never have heard of if this was the case back then.

It's part of the process, they have to follo wsteps or else every kid and young adult in the US would be in court.

Simply put it's illegal to DL in the US, not in Canada. It's illegal to UL in Canada however. Thats the twist.

I downloaded Cinderella Man a few years back and got a cease and desist email from Universal Pictures via Cogeco Cable. It was kinda freaky that they knew what I'd done. Any computer nerds care to tell me how they found out? I know Cogeco doesn't care and just forwarded the warning to save their asses.
