Default Cancelling a gym membership

Has anyone ever cancelled their gym membership?

I've been a memeber of the same gym for 12 years and these derfwards are trying to bleed me for every last cent and have referred to the, "conditions of the contract I signed."

My credit card expired that I pay monthly with expires this month and I've been meaning to cancel anyway, but their trying to hit me up for last months fee stating my card was declined(although they improperly wrote it down as Jan. 2009 on the bill they sent me) and some bullshit "declined fee" plus interest and want 30 days notice to cancel, so they want another months fees out of me.

I can't even remember when I last signed a contract, but it was at least three years ago and according to the Ontario Consumer Act of 2002, it's illegal for companies to have contracts that last more than a year without a renewal process.

I'm thinking I should tell them to back off or I want the last 2 years of monthly membership fees reimbursed since they were charging me while I wasn't legally under contract.

Which is why i'll only go to the YMCA, no contracts, quit anytime without penalties, basically pay for only as long as you want. I remember when i got a membership to GoodLife fitness and when i wanted to cancel the same thing happened to me. That's pathetic since you don't even have a contract. Where is it?

hmm.... is there some goverment office you can call re: the consumer act and just ask them what is within your rights?

I don't know anything about this sort of thing unfortunately.

Your 'threat' does sound pretty viable based on what you said though. I'm guessing you want to go that route, eh?

Put a stop payment on your account for that monthly payment. After informing them of your cancelling of the membership of course. If you're no longer under contract and cancel, theres nothing they can do. You may have to make one more last payment depending on the timing of the cancellation though.

you're in a sweet position acie, since your credit card expired.

you are right about the act and no contracts without renewals each year. i checked this with a lawyer that i have on retainer/marriage...

but you are wrong about asking them for 2 years worth of fees since you used the services during that time (i assume you did anyways). you would lose that battle.

my bro-in-law worked for a gym (goodlife) and told me that they are allowed to cancel contracts, but they have to do everything they can to squeeze you for as much dough as possible before you go. that's what is happening now. but if you walk away and just get a new credit card number they have no way to charge you except to sue you. this would cost them a lot of cash and they would probably lose since you don't have an active contract anyways. you can basically tell them to fack off and just walk away.

I haven't used the membership since Nov. 2008. I work out at home now...sometimes.

I should've totally cancelled it back then, but I truthfully just never have gotten around to it. I'm assuming that even if the original contract I signed said keep charging me until I say otherwise, it is BS since it's illegal to have such a contract.

I found this at the Ministry of Consumer Rights page.

All contracts must end after one year. Contracts may be renewed only if the supplier complies with certain rules, including:

Providing you with a notice at least 30 days, but not more than 90 days before the contract expires, that advises that the contract will be renewed.

Provides you with a copy of the agreement that clearly notes any and all changes.

States that the contract will not be renewed if you notify the club not to renew the contract.

If you received a renewal notice and did not respond to it, the club has the right to renew and bill you under the renewed contract.

If your membership is renewed without notice, send the company a letter asking that the contract be terminated. You can also demand back any money paid after the original contract ended.

I wouldn't pay them. Sounds like you have enough balls in your court.

Myself, apparently I owe blockbuster video 300 bucks and some private parking company like 2 bills or so.

They won't see any of that money and as for credit rating .. BHAHAHAHAH whats the big deal on credit anyways you pay for what you can afford.

tell them to kiss your ass.
if they threaten to sue you tell them to go ahead, and laugh in their face.
Gyms will never sue members because it will give them bad publicity and it will be even more expensive then the 40 bucks owed to them in the first place.
the next time you go in their and talk to desk clerk, just laugh at him/her... then ask to speak to the manager and laugh at him/her too.

Since we're talking about Gym memberships.....

I also had/have a membership with Goodlife. Had one for about 7-8 years actually before I put it "on hold" since I stopped going. One day (last year) I decided to go back and they took my card away citing that I owed them $300 in backed fees. I wasn't about to pay that on the spot so I walked and left me card with them (expecting them to bill me or send me a notice).

It's been over a year now and I haven't heard squat from them. So I'm wondering what the deal is..... kind of sucks because I'm itching to get back to the gym now lol... but I'm really not relishing shelling out that much dough to get started again.

Should I be concerned?

That surprises me considering every cell phone company out there lures people into the three year contracts with the discounted phone, and then charges an obscene cancellation fee to get out of it.

I had a similar situation with Goodlife 3 years ago. I forget the specifics, but yes, they're vultures.

Yeah.... not many alternatives though since there's no YMCA close to me... and I'm not going to Premier (they're even worse than GL).
