Yes. He likely wasn't massively stupid. But he could have killed someone all the same. Anyone can kill while driving. Knowingly increasing the risks is not a great idea.

99.99% sure. If he blew .08 at the time, say an hour or more after he was spotted at the wheel, he's still over. Likely was higher than .08 in that case.

Seen by who? It's basically someone's word vs his. My guess is he admitted to driving the car and they administered a test at that point.

Exactly, that person's word vs his. The cops shouldn't be able to charge someone going by someone at a fast food drive-thru. I still say they showed up at the door and he admitted to having attended the drive-thru and they then administered the test. If he denied to be the driver what do they have other then some McDonald's employee's word?

He most have admitted to it. The question is did he have any more alcohol after he got to the house where he was caught? If he keep drinking, then he could have blown 0.08, while being 0.01 an hour before wile driving.

Of course this is as obvious to me as it is to the police, so if they charged him, he most have admitted

I doubt if there's a drive thru in the world that doesn't have a camera which gives full view of the drivers face.

Good on the employee in the drive-thru for calling in. I guarantee you he was going to do it again. Open containers in full view to me means you are actually starting to believe your disneyland experience. I said once in a group setting that I would totally call in and tell if I saw someone driving drunk, and people acted like I was some asshole.
