Default Garbajosa suit could top $14 million

This would be huge if this claim is won by us.

In the 19-page document, MLSE seeks 6 million Euros ($9,440,000 Canadian) in damages for breach of contract, negligent misrepresentation and negligence if Garbajosa has suffered permanent disability or 1.5 million Euros ($2,517,000 Canadian) for temporary disability.

Garbajosa, who earned $3,416,667 (U.S.) last season, is to earn $3,666,667 for the current NBA season and $3,916,666 for 2008-09.

"He was a hard-working player and a solid defender and his absence from the starting lineup is a significant loss to the team," the Raptors stated in their claim.

MLSE is also asking for $5 million (Canadian) in punitive damages.

How do you figure? The team isn't suing Jorge. I'd like to think he's mature enough to know and understand its a business and unfortunately his federation are neglecting to realize the severity of this claim. Spanish Federation would do the exact same thing if the shoes were on the other feet.

It doesn't help the Raptors team on or off the court. It probably fucks up chemistry more and adds tension with our Spanish players.

The only one who potentially benefits is the organization that pays our team...

and how do you figure it would be huge "for us"? It's not like our cap-space increases by 14 millions or anything. It's just more money for MLSE, you don't think they'd lower the ticket prices if they win, do you?

In any case, the 5 million in punitive damages are probably just the dangling carrot for the spanish, if they agree to settle, those will probably be thrown away - just further incentive for a quick settlement.

As for the chemistry, that's ludicrous, why would Jose/Jorge give a shit about their federation, it's not like they would go bankrupt. And even if they do, tough luck - the Raptors told Jorge not to play, if he would have listened, there would be no suit.

Yeah, if anything this is going to have a negative impact on the team.

And just when we were starting to forget about the Nate Huffman lawsuit. lol

Simple: the Spanish bball federation does not want to pay us $14M for tampering with Garbo. Undoubtedly they'll make him pick sides and say that their doctors gave him the OK. It can be settled quickly, but it also has potential to get really messy.

First of all the spanish federation is not going to pay that money cause they simply dont have it. If this goes too far(wich I doubt) they will ruin the spanish national team.

I just guess who has to pay it's the insurance company.

BTW:

FEB.ES

Press Release regarding the claim made by Raptors to M. Madrileņa insurance for Garbajosa´s injury
18/03/2008 The following is an official press release by the Spanish Basketball Federation regarding news that has cropped up about a supposed claim made by the Toronto Raptors team to Mutua Madrileņa insurance for the agreed upon quantities that the NBA team signed for in the policy endorsed by the FEB, which allowed Jorge Garbajosa to play in EuroBasket 2007 with Spain’s national team.

Quote:
In view of the news that has appeared in different media sources regarding the supposed claim made by the Toronto Raptors against the FEB to demand the policy money for Jorge Garbajosas’ injury, the FEB would like to clarify that:

1) As of right now, the FEB has had no notification about any claim being made by the Toronto Raptors against the organization.??

2) The FEB scrupulously complied with the requirements that the NBA team had requested of the Federation by endorsing the insurance policy which was desired by the Raptors, and approved on September 2nd, 2007.

3) Since the endorsement of the mentioned policy, the FEB hasn’t received any solicitations for pay of the policy money, as the case should be, since the organization complied with its payment, and no other kinds of obligations derived from the situation with the NBA team.

4) The FEB will always look to collaborate to achieve satisfactory results for all interested parties.

5) The FEB hopes that Jorge Garbajosa has a speedy recovery, and that he, and his team, the Toronto Raptors, achieve great success in athletics.

6) Lastly, with the aim of not having impact on the normal operation of activities, the FEB abstains from further commentary regarding this topic.

actually, I don't think Jorge would have any official part in this thing. It's irrelevant whether he had the permission or not, all it matters if his injury was aggravated because he played in the euros.

That and he opted against further surgery which the Raptors recommended.

It's a sad story and i dont' think Garbo will be looked down apon no matter how it happens. The man just wants to play...can't fault him for that.

I don't think this is will have a bearing on whether we'll be able to sign Calderon. This is nothing personal, it's simply business and Calderon will understand that. If a party doesn't honor a contract, a lawsuit is natural. I think as long as Jose is offered a fair deal in the off-season, this will not play a part in his decision making. However, if we low-ball him, this will have an effect.
