Because imo, this is a case that screams being charged as an adult and put in a cell and throw away the key. Pathetic!

The 14 year old at the time Tuopeh was originally charged as an adult but later sent to juvenile court where he pleaded guilty to sexual assault, kidnapping, three counts of sexual conduct with a minor and one count of attempted sexual conduct with a minor.

Unless a judge rules otherwise, he will remain on probation until he is 18. If he had been convicted in adult court, he could have been sentences up to 21 years in prison.

As Hip-Hop Wired previously reported, Phoenix police believe the two 10-year-olds and a 13-and 14-year-old boy lured the girl to a storage shed and raped her on July 16. The case gained national attention after it was reported that the girl's father was ashamed of her and did not want her returned home.

thats just stupid. sentencing shouldn't exceed the duration of their life so far. as sick as these events are, neither should be trailed as an adult or imprisoned with them at any point. they're young enough have the rehabilitation system work for them. hopefully people care enough about their jobs to prevent these kids from going to the pen.

I think the max a minor can be sentenced to is up to age 21 in juve

our system is different from the states. in both instances, i believe they'd go to a group home.

There was a 12yr old kid in the states that murdered a little girl in the 90's and was charged as an adult. He's still in prison and in his late 20's. I believe he got 20-life. Spent the first portion in some kind of juvenille system and was then transferred to adult prison.

it depends on which state and what the crime was as well, law is a complicated thing

At 15 you know how fucked it is for rape an 8 year old.

Thinking about it makes me sick and angry... Think of how young an 8 year old really is. A 15 year old is in high school... they've learned wrong from right.

he was 14, and 14 year olds don't understand the consequence behind things like this. they might understand that it's wrong, but the severity? i really doubt it.

So at 14yrs old you don't think that one knows that raping an 8yr old is illegal and is criminal? Come on, this day and age kids that age know more then most adults half the time. I would say he knew the severity of his actions. IMO rape, murder (knowingly planning, not accidental of course) are crimes that any teenager should get tried as an adult. Depending on the cicumstances.

Example: a 14-15yr old kid goes to school, brings a gun and guns down a fellow student. He knowingly did it, planned it and don't even try and tell he didn't know the severity of those actions.
