A person like Perez Hilton has ruined the lives of many people yet when confronted, didn't have the ability to actually defend themselves. The only reason to sue, is because of potential damanges to income and that's what happened in this case.

Freedom of speech and all that, I agree with a bit of it. Thing is brother, I think the precedent being set here deals more with defamation. Using apublic forum to make false statements that hurt another persons image, or defame thier charactor is basically against the law.

I think thats what most people here are talking about Snoochy. Ya know.

Yeah I know SJ, but I just cant get past the thought of getting punished for saying something about someone whether true or not.

Next will be literature. Not allowed to right anything bad about someone else in some autobiography. Suppose that A&E Biography will have to be changed around so that nothing makes the person look bad. And E true Hollywood stort same thing.

Well to be honest Snooch, those programs have some serious Lawyer teams that comb each episode before they air to make sure they are clean from defamation.

It's a tricky topic, and it's a hard thing to prove in the courtroom, however, you simply cannot say anything about a person that isn't true and pass it off as truth.

The tricky part is the line between truth and opinion.

I tend to sit on the Models side because I hate Media culture when it builds celebrity up just so they canmake bigger stories tearing it down. It steals it's audiences identities over time.

Their are things you can't say Snooch. There are laws against it. Always has been. It's called slander, in this case libel.

When it comes down to it - all any of us have is our reputations. If we're all left with as little recourse to protecting that as public figures like Wacko Jacko are afforded, but without the ability to buy air time or present ourselves on various stages or in various media sources, then there's very little left for humans as individuals. The individual, as empowered from the Renaissance onward, may in fact be a thing of the past.

Maybe I read it wrong, but I thought this was more about the anonymity than the defamation. I think Cohen stated that she hasn't decided if she will sue for slander or not, despite phoning to say she forgives the blogger.

The suit she won was to force Google to reveal the name of the blogger, wasn't it?..... that's the real issue here, in my opinion.

Maybe, maybe not.

Depends on how many potential customers read 1 particular bloggers posts from 5 years ago on his personal little bit of wordpress.

And if they did I wouldnt want those customers in the first place.

If references of all my my hypothetical kids at my daycares parents saying how great I am at my job, or maybe the governemtn regulations in my province in regards to daycares proving the absolute opposite of that wasnt good enough to over value some annonymous bloggers comments then so be it.

If it was a newpaper or on the news then I sort of agree with Libel law, on some blog or even the National Enquirer Mag shouldnt matter.

Honestly, I think that part of the problem lies in the fact that there are people out there who are emboldened by the anonymity that the internet provides them. In short, they say A LOT of things over the web that they wouldn't dare say in person because they know that the object of their ridicule can't confront them.

I haven't seen too many people who are as brash and abrasive in person as they are on the internet.... hmmm... I wonder why? lol.
